In the following terms and conditions “the photographer” shall mean Sparkle Services NW and its employees. “The clients” is the person that employes “Sparkle Services NW” that is specified on the invoice. These terms & conditions can not be varied in any way by the clients unless sich conditions are agreed with the photographer in writing/
1. COPYRIGHT
The copyright Designs and Patents Acts assign the copyright of all images to the photographer
2. DISPLAY OR COMMERCIAL USE
The client hereby allows the photographer to display any image covered by this contract to promote the business, whether that be by advertising, use on website, sample albums etc. If the client does not wish for the images to be used in this manner then they should give reasonable notice to the photographer prior to the event.
3. CREATIVE LICENSE, COVERAGE AND REPRODUCTION
I. Photographs taken during the event will be at the discretion of the photographer, though every effort will be made to grant the requests of the client in an ad-hoc situation
II. Special requests are not a binding instruction, although every effort is made to comply with the client’s wishes, the photographer will do their benest to honour the prior agreement and specification of the work as set out in the contract. The photography will try and honour special requests as much as deemed “reasonably” practicle.
III. Due to a large range of different lighting conditions experienced at events and the limitations of digital sensors, some colour and lighting may alter throughout the course of an event in the end product.
IV. The photographer will only, digitally enhance the photographs and all the photographers work will be in-line with the portfolio as shown and described on our website. Any “photo-shopping” and “re-touching” should be discussed prior to the works and this will incur and extra charge.
V. Although all of the equipment is checked before each event, the photographer will not be responsible for photographs should a sudden technical error happen during an event.
VI. In some events, specific angles and shots will be difficult to take, the photographer takes no responsibility for lack of lighting, hard to reach areas and will not be expected to position themselves where they may be at risk.
VII. For Drone usage it is up to the client to gain all permissions prior to its usage, for roof surveys, although it is not a legal requirement it is recommended that informing your neighbour of the incumbent survey is best practice.
VIII. The photographer will take no responsibility for weather changes, or fly in any area that could lead to “loss of sight” as this is against the drone code.
IX. The video quality will be 1080p for all videography services and will be produced in this definition and any alternations, the request should be made before the event.
X. The photographer will not be held accountable for any opinion expressed in a “roof survey” or other similar work. The photographer will only provide photographs to the context of personal opinion of where a problem may lie. It is recommended to get a 2nd opinion from a qualified professional.
4. PAYMENT
A 25% deposit is required to book the photographer and full payment must be made on the day before, any alteration to this must be agreed prior to the event. There are no refunds unless it can be demostrated that the work is not in comparision to the standards set out in our portolio.
5. CANCELLATION
If the client wishes to cancel the event, then at least 7 days notice is required, so that the remaining balance does not have to be paid, the deposit is non-refundable.
In the unlikely event that the photographer cancels, then all monies will be refunded.
6. DIGITAL FILE NEGATIVES
I. All digital negatives remain the property of the photographer. Our policy is that following an event the negatives are uploaded to our cloud based server, where you will have a chance to download them or print them via an avenue of your choice. They will remain on our server for 365 days from the date of the event. You do have the albility to purchase a USB drive where the negatives can be sent via the postal service.
II. Any loss to the digital negatives for any reasons beyond control, then the photographer will be liable for a full refund of the products that have not been receieved by the client
7. THE EVENT
I. The photographer shall be the only professional photographer at the event
II. Please specific whether catering is provided for the photographer
III. Please specify if there are any limitations or preferences to that you wish the photographer to adhere to. E.g. do not drink alcohol, or avoid certain areas
IV. The photographer does not take photos of people eating.
V. The photographer will only be available for the duration specified on the contract and any change will have to be negotiated.
8. PERSONAL ACCIDENT
It is the clients responsibility to inform all guests that a photographer will be present and during a photograph shoot there is an element of unforseen risk. The photographer cannot be held responsible for any personal accidents during an event.
For drone usage, insurance will be attained by SUPERSCRIPT. There will be at least £750k liability cover that includes invasion of privacy insurance. In the case of an airborne accident, the photographer will take responsibility where it is reasonable to do so.
9. DELIVERY OF PRODUCTS OR SERVICES
The photographer has a standard time of 2 weeks to upload or deliver the finished negatives and video. In certain situations in a large event and there is an extra amount of editing to do, this time of 2 weeks may be extended to 4 weeks depending on the scale of the project
